Eligibility

Win a Decorating Den 40 and Fabulous Dream Bedroom Makeover Sweepstakes (the "Sweepstakes") is open only to legal residents of the forty eight (48) contiguous United States and the District of Columbia who are at least twenty one (21) years of age at the time of entry. Void in Alaska, Hawaii, U.S. territories and possessions, Puerto Rico and where prohibited by law.

Employees, shareholders, directors, officers, affiliates and franchise owners of Decorating Den Systems, Inc. as well as the immediate family (spouse, parents, siblings, and children) and household members of each such person are not eligible. Prize is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sweepstakes governed by U.S. law. Sweepstakes is subject to all applicable federal, state, local laws and regulations.

Timing:

The Sweepstakes begins September 1, 2009 and ends October 26, 2009 ("Sweepstakes Entry Period"). Entries must be received by 11:59 PM Eastern Time on October 26, 2009.

HOW TO ENTER:

There are two methods of entry. You must answer all survey questions in order to submit a valid entry. Method #1: To enter online, visit www.decoratingden.com/enter and follow all online instructions to complete and submit the online Entry Form in its entirety. Online entries must be received by 11:59 PM (ET) on October 26, 2009. Online entrants subject to all notices posted online, including but not limited to Sponsors' privacy policies. Method #2: To enter via U.S. mail, (i) complete an entry form (ii) and mail to: The " 40 and Fabulous Dream Bedroom Makeover" Sweepstakes, 8659 Commerce Drive, Easton MD 21601. Mail-in entries must be postmarked between September 1, 2009 and October 26, 2009 and received by October 30, 2009. Sponsor is not responsible for lost, late, damaged, illegible, garbled, inaccurate, misdirected, undelivered, delayed or postage due mail/entries. No photocopied or mechanically reproduced, altered or incomplete entries will be accepted. All entries, regardless of entry method, become the Sponsors' property and will not be returned or acknowledged. A PARTICIPANT MAY ENTER ONE (1) TIME DURING THE SWEEPSTAKES ENTRY PERIOD.

Random Drawing:

One (1) potential winner ("Winner") will be selected in a random drawing on or about November 1, 2009, from among all eligible entries received will be conducted under Sponsor's supervision.

The Prize and Its Approximate Retail Value ($10,000) ("ARV"). One (1) Grand Prize consisting of: a custom single residential bedroom design plan (remote consultation with photos, via phone, email, or mail, at Sponsor's discretion), including (1) bedroom professionally painted by a CertaPro Painters valued at $2,000 with choice of Benjamin Moore paint color for one (1) bedroom in winner's home from Benjamin Moore valued at $200, custom window/bedding products from Carole Fabrics valued at $1,250, custom window fashions from Hunter Douglas valued at $1,500, a 6'x9' Nourison Rug from selected lines valued at $1,000, Kincaid Furniture valued at $1,875,and accessories/lighting supplied by Decorating Den valued at $2,175. Prize is nontransferable, and no substitution will be made except as provided herein in the Sponsor's sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning the prize depend on the number of eligible entries received during the Promotion Period.

The total prize package ARV is $10,000. Labor and installation are included with any prize component. Instructions for prize redemption will be delivered approximately thirty (30) days from date of winner verification. Prize package must be redeemed by December 31 2009. Sponsor reserves the right to substitute a prize (or portions thereof) of equal or greater value if prize (or portions thereof) cannot be awarded as described. Sponsor will determine all elements of prizing in its sole discretion. Prize may not be assigned, transferred, changed or redeemed for cash, except at Sponsor's sole discretion. Prize is awarded "as is" with no warranty or guarantee express or implied by Sponsor. Sponsor disclaims all and any liability for the actual provision, quality or nature of any third-party product or service accepted by the winner. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by Official Rules and agree that if winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated Official Rules, or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to an alternate winner in a random drawing. Entrants understand that Sponsor is not liable for injuries, losses, or damages of any kind arising from participation in this promotion and acceptance, possession, and use of prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes or in the announcement of the prize. Decisions of Sponsor are final and binding in all respects. By participating in the Sweepstakes, you: (i) agree to be bound by these Official Rules, including all eligibility requirements; and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.

The odds of winning depend upon the number of eligible entries received.

Privacy:

When you register, we collect personally identifying information about you, including your name, mailing address, telephone number and email address. The information that you provide will be added to a centralized Sponsor database. By entering and providing the required registration information, you acknowledge that Sponsor and its Decorating Den Franchise Owners may send you information, samples, or special offers for products or services it or they believe may be of interest to you. Sponsor may also include your name and postal address in postal address lists that Sponsor sells or rents to third parties for marketing purposes. Dispute Resolution:

Except where prohibited, by participating Sweepstakes entrants agree that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of Maryland without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the prize, shall be filed only in the state or federal courts located in the State of Maryland and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Sweepstakes, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.

Other:

Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, or lost entries. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of these Official Rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention or force majeure. In the event of cancellation, Sponsor reserves the right to select winner from among all eligible entries received prior to date of cancellation. The use of automated entry systems or any other conduct that impedes the integrity of the sweepstakes is prohibited. In the event of a dispute regarding online entry, entry will be deemed made by the holder of an established e-mail account associated with the entry.

General:

Except where prohibited by law: (i) entry constitutes permission to use winner's entry, name, hometown, voice, likeness, photograph and any statements regarding this Sweepstakes for editorial, public relations, promotional and advertising purposes on behalf of Sponsor and its affiliates without compensation; (ii) potential winner will be required to complete and return an Affidavit of Eligibility and Release of Liability/Publicity within ten (10) days of notification or an alternate winner may be selected by random drawing. If winner notification is returned as undeliverable, an alternate winner may be selected by random drawing. By participating and winning a prize, winner releases Sponsor, its parents, affiliates, subsidiaries and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the Sweepstakes. Taxes on prize are the sole responsibility of the winner. Winner will be issued an IRS 1099 tax form in the amount of the ARV of the prize. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any prize. Sponsors are not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prize.
